1. VALIDITY OF GENERAL TERMS OF USING THE APPLICATIONS ON PORTAL TRG NEPREMIČNIN
General terms of use refer to the use of the content on portal Trg nepremičnin and the applications, as well as all other products and services, available on the web address: www.trgnepremicnin.si
The revised and valid version of general terms of use is available on portal Trg nepremičnin.
Geodetic Institute of Slovenia reserves the right to change the application and general terms of use at any time. The changes to the terms of use shall come into effect immediately the next day after the announcement on portal.
Geodetic Institute of Slovenia will notify its registered users about any changes to the terms of use or the application via e-mail. Should the user not agree with the changed terms of use, he can end the contractual relationship, but Geodetic Institute of Slovenia will not reimburse him the proportional part of pre-paid subscription.
2. INTELLECTUAL PROPERTY RIGHTS
The complete content on portal and the applications are copyright protected as individual creations or data collections. The use of copyright protected content is permitted only in accordance with general terms of use, instructions for using the applications (in the following referred to as ‘the instructions’) and valid legislation.
3. PERMISSION OF USE
The content and applications on portal are permitted to be used in a manner, stated in the general terms of use and instructions.
Any reproduction and distribution of data and the results of working with the application on portal, their moderation and inclusion into another web site, product or service is prohibited, unless specifically stated in the instructions.
The above stated prohibition applies to any forms of use, which in their manner exceed general use. The following actions are explicitly prohibited:
- collecting and using considerable parts (in quality and/or quantity) of data base (e.g. reproduction of data base structure, parts of data base structure, designing public data bases etc),
- using data base in a manner that is contrary to general use or which could harm the interests of Geodetic Institute of Slovenia,
- removing stated sources.
Users hereby bind themselves not to carry out any actions that might disturb or harm the functioning of the application, its system and network or other users.
Users are responsible for any damage that might be caused to Geodetic Institute of Slovenia due to violation of general terms of use and instructions.
Users must use the data in accordance with the valid legislation.
4. CONTENT AND MANNER OF USING THE APPLICATIONS ON PORTAL TRG NEPREMIČNIN
4.1. ACCESS TO APPLICATIONS
All applications are accessible on the following web address: www.trgnepremicnin.si. In order to use the applications, users must register on the portal with their own user name and password.
All users are registered as natural persons, regardless if the payer is a legal entity.
Users can register in accordance to the instructions. All users hereby bind themselves to protect the confidentiality of chosen password for accessing the applications on portal and take the responsibility for any data, changes and actions carried out by using their user name.
Geodetic Institute of Slovenia will charge its users the use of application according to the price list, published on the web site www.trgnepremicnin.si/cenik.php
4.2. CONTENT
The content on portal consists of various real estate data and data about real estate business agreements.
4.3. MONITORING THE USE OF SERVICE
Geodetic Institute of Slovenia monitors and records access data and users' actions in accordance with the Personal Data Protection Act.
5. LIMITATION OF LIABILITY
Users use the application and data at their own risk.
Geodetic Institute of Slovenia does not bear any liability for any moral or material damage that might appear as a result of using the application and data. Geodetic Institute is not liable for credibility and accuracy of data acquired from various owners or data managers.
Geodetic Institute of Slovenia bears no responsibility in case of data loss or unwanted data changes, arising from network malfunction or malfunction of application user’s computer hardware or software.
Users must provide all due precautions, necessary for undisturbed and safe data access and protect their information systems (anti spyware protection, anti-virus protection, anti-malware etc).
In case of superior force (temporary system failure, e.g. due to stroke of lightning etc) and urgent, unforeseen or maintenance work on the system, the portal manager does not bear any responsibility in case of caused damage.
6. PRIVACY PROTECTION
Geodetic Institute of Slovenia is bound to protect users' personal data. All users agree to the fact that Geodetic Institute of Slovenia claims the right to accessing, saving and revealing information about the user (user name and password) and any other user-related data in case of breach of general terms of use or instructions or violation of legislation. In the above mentioned cases, Geodetic Institute of Slovenia can transfer relevant data to competent institutions.
7. PRIVACY PROTECTION
Geodetic Institute of Slovenia undertakes to devote all its efforts to ensuring a constant, reliable and safe functioning of the applications on portal.
In case of function errors, noticed and reported by users, we will deal with them preferentially and eliminate them in the shortest time possible.
In cases of regular maintenance work on the application software or hardware, Geodetic Institute of Slovenia will ensure undisturbed system functioning or it will properly notify its users about possible errors in the application functioning.
Geodetic Institute of Slovenia reserves the right to shortly interrupt the functioning of the application due to urgent or unforeseen maintenance works on the system. When doing so it will strive to do so in the period of reduced presence of users.
8. VIOLATION OF TERMS OF USE
In case Geodetic Institute of Slovenia discovers any violation of terms of use, it has the right to prevent the users from accessing the applications as well as carry out other necessary measures.
9. DISPUTE RESOLUTION
Any claims or disputes between the users and Geodetic Institute of Slovenia shall be resolved in peaceful manner. Should that not be possible, claims and disputes shall be resolved by the competent court in Ljubljana.
